Jilly's Killer

   

Here is a copy of the letter I sent:

Chuckawalla State Prison Re: Peyrotte, Jeffrey CDC# H89472 March 26, 2002

To whom it may concern:

Mr. Jilly Rizzo was a very close friend to my family and to me. It has come to my attention that the hearing for the person who caused his death is pending and I would like to add my thoughts to the process.

Mr. Rizzo was a wonderful man with a fine family. He was a fiercely loyal friend who gave much of himself to charitable causes and never asked for anything in return. To think that someone who so carelessly took his life away from all of us who loved him so much, might be set free, is too painful to bear.

My friend died in a horrific fire in a car because someone who was drunk was behind the wheel and speeding in another car. Mr. Peyrotte made a weapon of his car and used it to kill Mr. Rizzo.

Completely innocent, and on his birthday, Jilly Rizzo was hit, caught fire and roasted to death, all the while fully aware of what was happening to him. Yes, he choked and burned to death. We can only imagine the terror he must have experienced during those final, frantic, tragic moments. The images are still etched and still cause great stress for all of us, especially his children. The terrorists of 9/11 have nothing on Mr. Peyrotte. They used airplanes. He used his car.

In the name of justice, please consider this matter very carefully for Mr. Rizzo’s family and friends. Please use this case as an example so that others will not drive while drunk. Please make the punishment fit the crime of murder.

Dear Nancy,

This is so awful. Jilly died in such a horrible way, and on his Birthday. I remember how your Dad dropped to his knees and wept when told about what had happened to Jilly.

First, Mr. Peyrotte was sentenced to 15 years to life, however, he has currently served less than ten years of that sentence. Second, Mr. Peyrotte has a history of previous drunk driving offenses. Third, is there any evidence that he did call 911, or did he leave the scene of the accident, period? Fourth, I cannot help but wonder why one of his daughters doesn't want him to be released. Fifth, how bizarre it must feel to have the awful coincidence of the name "Lambert", of all names, linked to Mr. Peyrotte. Sixth, I cannot help but wonder what Jilly and Frank would want for Mr. Peyrotte, since he has been described as being reformed. Seventh, being reformed can not guarantee that Mr.Peyrotte will not ever drink and drive and kill again. I believe in forgiveness, however, I also believe in a Person's right to drive on a road that is totally absent from drunk drivers.

Dear Nancy,

I understand that You want Justice for the murder of Jilly. Mr. Peyrotte robbed Jilly of his Life because Mr. Peyrotte was driving drunk. Jilly suffered horribly, and died on his own Birthday. Jilly had no choices. Jilly had no opportunities. Jilly didn't have a chance to say goodbye to his Family and Friends. Everything was taken from Jilly that horrible May night in 1992. Mr. Peyrotte, on the other hand, still had his Life, his wife, and four children. He still had time to go to school and earn a masters degree and a doctoral degree. Everything was not taken from Mr. Peyrotte on that horrible May night in 1992. He has been able to speak to and visit with his Family and Friends. He had a choice that night. The choice was not to drink and drive. His choice to drink and drive resulted in the loss of a Life, not his own, but that of Jilly Rizzo.

Please ignore "Fourth..." in my first comment above. I misunderstood the April 3rd "Desert Sun" Report to state that one of Mr. Perrotte's Daughters was opposed to her Father's release from prison.

Man faces jail for Web sales of CDs

An Austin, Texas, man could face up to $100,000 in fines and a year in jail after pleading guilty to distributing live concert recordings of actor Russell Crowe's band over the Web, U.S. attorneys said.

The U.S. Attorney's Office for the Northern District of California said Thursday that Billy Joe Acosta pleaded guilty to one count of criminal copyright infringement in connection with selling at least 10 copies of a live performance of the band Thirty Odd Foot of Grunts on eBay and Yahoo.

He will be sentenced June 11 in federal court in San Jose, Calif.

In his plea agreement, Acosta admitted to recording a performance in Austin, Texas, and making $700 from selling the items, including a sale to a California resident.

Russell's band is on an independent label and it's certainly not fair to rob TOFOG of their royalities. Russell isn't in it for the money as he pays his band members while he's at his day job. However I hate seeing the rest of the band robbed of their royalties.

I've always been fascinated by this issue. Why doesn't the artist just release a concert recording if demand exists? The quality would be better and the artist would collect royalties. I'm not siding with the bootlegger(s), but I fail to see how any royalties are being denied if the recording is unavailable by legitimate means. The same people who buy the bootlegs will buy the legitimate release when (if) it comes out. Look no further than the Grateful Dead for proof.

Just have to say that TOFOG has released two cds in Australia that you can buy over the net. Also the latest TOFOG cd is availlable in the USA on an independant label. They have a live concert dvd that was available at their shows this past summer and there will be a similar dvd release soon with extras added. So this particular group has released live concert recordings on dvd and on cd. It's not fair to this group to rob them of royalties through bootlegging. The same goes for Frank's family when bootlegged material is out there on Frank. I actually signed a form not to sell the dvd I got at the TOFOG show as it was autographed by the band and a limited numbered release. As Russell said the money from sales went to charity (Austin charity) and they didn't want to see the dvd end up on Ebay. Enough said.

It isn't alway about the royalties. It also, in Mr. Sinatra's case, involves the "integrity" of the work. His family is only looking out for him, and keeping the "flame" by releaseing material he would have approved of. Many artists have material that is not their favorite, or up to their standards, and would not want it made public. We are consumers and fans, must respect the fact that they give their best, and we should leave the rest, if they choose not to release it. That's just my take on the situation...

I am a relative newborn when it comes to this issue. I say that so that the following comments be taken from that point of view. I don't know much about the guts of this subject. All I know is that I'm a Sinatra music fan who desires to hear
all the Sinatra that I possibly can. Does this make me a bad person? Perhaps. But I would never want to do anything or say anything that would upset the Sinatra family. I just happen to be crazy about the man's singing. I don't think that there is a unreleased track that could change that. If anything, I believe it would enhance it. However, I respect the Sinatra family's right to what is lawful. I have NEVER purchased a bootlegged or pirated product. I have never even heard one. But I must admit that I have a desire to hear the "Lush Life" takes. Not because of any lack of respect for Mr. Sinatra, but because I believe him to be the greatest singer that ever sang those type of songs. I'm not trying to hurt anyone when I wish to hear these things. I only love to hear the man sing. Like I mentioned earlier, I don't know much about the issue and I hope that I might gather some feedback so as to help enlighten me.

I agree that many recordings exist which the artists never intended to be made public. For years, a "bootleg" of an outtake from Bing Crosby's Decca session existed, where Bing ad-libs and curses at the end of the flawed take ("Wrap Your Troubles in Dreams"). MCA chose to release this outtake in the Bing Crosby box set of Decca reissues, which I believe to have been a mistake. Bing's audience always identified with him as being like his character of Father O'Malley. Sure, he was human like the rest of us, but did his label have to taint his image so many years after his death? From 1934 through the late 1950s, Bing Crosby basically WAS the moneymaker for Decca Records. Nice slap in the face, guys.
